These Terms & Conditions apply to orders placed with Cakes by Alison. Please read them carefully before placing an order or confirming a booking.
By placing an order, accepting a quotation or making a payment to Cakes by Alison, you agree to the terms applicable to your order.
Nothing within these Terms & Conditions affects your statutory rights.
1. ORDERS & BOOKINGS
All cakes and products are subject to availability.
For bespoke wedding and celebration cakes, your order will be based on the details agreed between you and Cakes by Alison, including the event date, venue, cake size, flavours, design and any delivery or set-up requirements.
Your quotation and any specific terms provided as part of your booking should be read alongside these Terms & Conditions.
It is the client's responsibility to check that the information provided on their quotation, invoice or order confirmation is correct and to notify Cakes by Alison of any errors as soon as possible.
2. PRICES & PAYMENT
All prices will be confirmed before an order or booking is accepted.
Bespoke cake prices are based on the individual requirements of each order, including size, design complexity, decoration, ingredients and delivery or set-up requirements.
A booking payment may be required to secure a date for a bespoke cake. The amount and payment schedule will be detailed in your individual quotation or booking information.
Your booking is not considered secured until the required booking payment has been received and the booking has been confirmed by Cakes by Alison.
Any outstanding balance must be paid by the date stated on your invoice or booking confirmation.
Failure to make payment by an agreed deadline may affect our ability to fulfil your order and may be treated in accordance with the cancellation provisions applicable to your booking.
Payments may be made using the payment methods offered by Cakes by Alison, including secure online payment through Worldpay where available.
3. WEDDING CAKE SAMPLE BOXES
Wedding cake sample boxes are produced on selected dates and are subject to availability.
Each box contains the flavours advertised for that particular tasting date.
The flavours offered as samples represent a selection of our wedding cake flavours. Additional flavours may be available when ordering your wedding cake but may not be available to sample.
Sample boxes contain freshly prepared, perishable food and should be stored and consumed in accordance with any instructions supplied.
4. CAKE DESIGN
Each Cakes by Alison bespoke cake is individually created by hand.
Reference photographs, inspiration images and previous Cakes by Alison designs may be used to establish the overall style of your cake. However, handmade and hand-painted work is unique and exact reproductions cannot be guaranteed.
Minor variations in colour, positioning, proportions and decorative details are a natural part of creating a bespoke product and do not constitute a fault.
Where flowers, ribbons, toppers or other decorative items are to be supplied by the client, venue, florist or another third party, this must be discussed with Cakes by Alison in advance.
5. CHANGES TO YOUR ORDER
Please notify Cakes by Alison as soon as possible if you wish to change any aspect of your order.
We will make reasonable efforts to accommodate changes, subject to availability and the stage your order has reached.
Changes to the size, design, flavours, venue, delivery arrangements or other requirements may affect the final price.
Where additional work or materials are required, any additional charge will be discussed with you before the change is confirmed.
Some changes may not be possible once specialist materials have been ordered, decorations have been created or production has begun.
6. ALLERGIES & DIETARY REQUIREMENTS
Clients must inform Cakes by Alison of any allergies, intolerances or dietary requirements before placing an order.
Our cakes are prepared in an environment where allergens are handled and cross-contamination may therefore be possible.
If you or one of your guests has a serious allergy, please discuss this with us before ordering so that we can advise whether we are able to accommodate your requirements safely.
It is the client's responsibility to communicate relevant allergen information supplied by Cakes by Alison to their guests where necessary.
7. DELIVERY & SET-UP
Delivery and professional set-up may be available for wedding and other bespoke cakes.
Delivery arrangements, venue details, access times and any applicable charges will be agreed as part of your booking.
The client is responsible for ensuring that the delivery address, venue information and agreed access arrangements are accurate.
Where Cakes by Alison delivers and sets up a cake at a venue, we will take reasonable care to ensure that the cake is safely positioned before leaving.
Once delivery and set-up have been completed, Cakes by Alison cannot be responsible for subsequent damage caused by inappropriate handling, movement, storage, excessive heat, direct sunlight, unsuitable display conditions or actions of the venue, guests or other third parties, except where Cakes by Alison remains legally responsible.
8. COLLECTION
Where collection has been agreed, the order must be collected at the agreed date and time.
We recommend that cakes are transported on a flat, secure surface in an appropriately cooled vehicle.
Once a cake has been collected by the client or their representative, responsibility for its safe transportation and appropriate storage passes to the client, except to the extent that applicable law provides otherwise.
9. CANCELLATIONS
If you need to cancel an order or booking, please notify Cakes by Alison in writing as soon as possible.
Cancellation of bespoke wedding and celebration cake bookings will be dealt with in accordance with the cancellation terms agreed as part of your booking and our Cancellation Policy.
Where work has already been undertaken or reasonable costs have already been incurred specifically in connection with your order, these may be taken into account when determining any refund due, subject to applicable consumer law.
Wedding cake sample boxes are freshly prepared and perishable. Please contact us as soon as possible if you need to cancel a sample box order. Where preparation has not begun, we will try to accommodate cancellation requests wherever reasonably possible.
10. POSTPONEMENTS
If your wedding or event is postponed, please contact Cakes by Alison as soon as possible.
We will make reasonable efforts to transfer your booking to your new date, subject to availability.
A change of date is not guaranteed until it has been confirmed by Cakes by Alison.
Changes to the date, venue, cake requirements or other circumstances may result in additional costs, which will be discussed with you before proceeding.
If we are unable to accommodate the new date, the cancellation terms applicable to your booking will apply.
11. PROBLEMS WITH AN ORDER
We take great care in preparing every Cakes by Alison order.
If you believe there is a problem with your order, please contact us as soon as reasonably possible and provide details of the issue.
We may request photographs or other information to help us understand and resolve the matter.
Where goods are faulty, not as described or otherwise do not meet the standards required by applicable consumer law, you will be entitled to the appropriate legal remedy.
12. CIRCUMSTANCES OUTSIDE OUR CONTROL
Occasionally, circumstances outside our reasonable control may affect our ability to fulfil an order as originally agreed.
If this occurs, we will contact you as soon as reasonably possible and discuss the options available.
We will take reasonable steps to minimise the effect of any such circumstances.
Nothing within this section limits any rights or remedies you have under applicable law.
13. PHOTOGRAPHY & OUR DESIGNS
Cakes by Alison may photograph completed cakes for our portfolio, website, social media and other promotional materials.
We will not intentionally publish private personal information about a client without appropriate permission.
Our photographs and original creative work remain subject to applicable intellectual property rights and must not be commercially reproduced or used without permission where such permission is legally required.
14. WEBSITE & PRODUCT INFORMATION
We take reasonable care to ensure that information displayed on our website and marketing materials is accurate.
Photographs are provided to illustrate our work and style. Due to the bespoke and handmade nature of our cakes, your finished cake may vary from photographs of previous designs.
We reserve the right to update our website, flavour selections, product availability and prices from time to time. Changes will not alter the price of an order that has already been confirmed unless a subsequent change to that order has been agreed.
15. LIABILITY
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
Subject to applicable law, Cakes by Alison will not be responsible for loss or damage resulting from the client's failure to follow storage, transportation or handling instructions, or from the actions of third parties after responsibility for the cake has passed to the client or venue.
16. YOUR STATUTORY RIGHTS
These Terms & Conditions do not affect your statutory rights as a consumer.
If any provision within these Terms & Conditions is found to be invalid or unenforceable, this will not affect the validity of the remaining provisions.
17. GOVERNING LAW
These Terms & Conditions are governed by the laws applicable in England and Wales.
Nothing in this section deprives a consumer of any mandatory legal protections or rights relating to where proceedings may be brought.
